Terms of Service
The following Terms of Service ("TOS," "Terms" or "Agreement") apply to your use of our website and all services, features and/or content provided by HostGraber (“HostGraber,” "us,", "our" ). HostGraber is a brand name of Sharspire (OPC) Private Limited. By purchasing one or more Services from HostGraber, you declare that you have read, understood and agree to be bound by this TOS. The latest version of our TOS is always available on the HostGraber website. You must read this TOS prior to purchasing any Service(s) from HostGraber.
Customer Agreement
The TOS apply to all Services provided by HostGraber to you throughout the entire Term or Renewal Term. All customers should agree on all terms and conditions stated prior to their signing up for any of the hosting plans and services mentioned on HostGraber. You shall agree to use only licensed and legal third-party software in connection with your use of our services. HostGraber reserves the right to suspend or cancel a customer's access to any or all services provided, at any time, or when HostGraber decides that the account has been inappropriately used or otherwise.
1. Content
HostGraber reserves the right to refuse service and/or access to its servers to anyone. The services provided by us must be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any applicable law or regulation is prohibited.
The activities listed below are meant to provide examples of activities and content that are strictly prohibited. Topsites, Ponzi or pyramid schemes, prime banks programs, bank debentures/bank debenture trading programs, cryptocurrency/bitcoin miners, forex, e-gold, proxy, bots, spam bots, mail bombers, port scanners, IP scanners, mail harvesting scripts, brute force scripts, chat rooms, banner rotators, file dumps, using disk space as secondary storage, sales of illegal pharma, drugs, explosives, anonymous or bulk sms gateways, malware, warez, phishing materials, lottery, gambling, illegal downloads, pirated software distributions, escrow, high yield investment programs, adult thumbnail galleries/banner exchanges, streaming or broadcasting of live copyrighted events.
Websites promoting illegal activities or linking to other websites that promote illegal activities. Website content that promotes or advocates human trafficking in any way shape or form as determined by HostGraber's sole discretion, sites that promote prostitution, or escort services.
Any website found to host child pornography, link to child pornography or exploitative content will be suspended immediately without notice or warning.
Adult materials - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of “adult material” is left entirely to the discretion of HostGraber. Embedding or uploading audio/video/high resolution images on website or linking to other websites that promotes audio/video/high resolution images.
Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any regulation or material that is perceived to be misleading.
Warez - This includes, but is not limited to, pirated software, ROMS, emulators, phreaking, hacking, password cracking, IP spoofing and encrypting of any of the above. It also includes any sites which provide "links to" or "how to" information about such material. Games - We strictly do not allow to host any kind of games on our servers. Your hosting account would be immediately terminated if we found any gaming related stuff in your hosting account.
IRC Hosts - Hosting an IRC server that is part of or connected to another IRC network or server or have a connection to an IRC network. Servers or Virtual hosting accounts, found to be connecting to or part of these networks will be immediately removed from our network without notice. The server would not be reconnected to the network until such time that you agree to completely remove any and all traces of the irc server, and agree to let us have access to your server to confirm that the content has been completely removed. Any server guilty of a second violation would result in immediate account termination.
HostGraber reserves the right to deem any other content or literature as "prohibited" if found to be indecent, rude, hateful content & generally unacceptable.

In compliance with DMCA act, HostGraber has adopted procedures for parties who believe that a hosted site on our service is infringing their copyrights. 2. Abuse Of Resources
Any attempts to compromise or actual compromise of a network device belonging to HostGraber or any other company, individual, or other entity is strictly prohibited. This includes port scanning, IP range scanning and vulnerability scanning. All infractions or suspected infractions will be vigorously investigated and may result in immediate termination of service.
Denial of Service (DOS) attacks directed at HostGraber, or any attempts to launch a Denial of Service attack from our servers are strictly prohibited and may result in termination.
Hosting illegal software, exploits, tools, hacking tutorials, viruses, trojans, or similar materials is strictly prohibited.
The hosting of defamatory, scandalous, or private information about a person without their consent is prohibited.
Any attempts to undermine or harm our servers will result in immediate deactivation without refund.
3. Unsolicited commercial e-mail/Unsolicited bulk e-mail (SPAM)
Use of our service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited.
If a customer is found to violate our SPAM policy, we may restrict, suspend, or terminate the hosting account. Severe violations may result in immediate and permanent removal without notice.
4. Bandwidth
If the customer exceeds their bandwidth limit and does not upgrade, the account may be suspended until resolved.
5. VPS & Server Rules
Control Panel Recommendation, unmanaged VPS responsibilities, backup liabilities, exclusions, best practices, and managed VPS options remain as described in your existing policy.
6. Commercial Advertising - Email (Spam)/Unsolicited Commercial Email (UCE)
Spamming from our servers is strictly prohibited and may lead to immediate deactivation.
7. Backup Policy
Your use of the Services is at your sole risk. You agree to back up all of your User Content. HostGraber does not warrant backup availability or recovery.
8. Domain Payments
Domain registration fees are non-refundable.
9. Unlimited Hosting
Unlimited hosting applies only to normal website hosting usage, not storage or backup services.
10. Permitted CPU and Disk Usage
Shared hosting space is for website files only and cannot be used for storage or archiving.
11. Reseller Terms and Client Responsibility
Resellers are fully responsible for their clients.
12. The Company as Reseller or Sublicensor
We may use third-party services and are not liable for their defects.
13. Uptime Guarantee
Downtime due to maintenance or external factors does not count toward uptime guarantees.
14. Account Security and Company Systems
You are responsible for securing your account and password. Unauthorized access attempts may lead to termination.
15. KYC & Verification Requirements
To maintain security, prevent fraud, and comply with regulatory requirements, HostGraber may require identity verification (KYC) from any customer at any time before or during the use of the Services.
15.1 Mandatory Verification:
HostGraber may request government-issued identification, address proof, business verification documents, or additional contact verification before activating, continuing, or restoring any service. The customer agrees to provide accurate and complete information when requested.
15.2 Verification Timelines:
Requested KYC documents must be submitted within 72 hours. Failure to comply may result in immediate service suspension. If the customer does not complete KYC within 7 days of the request, the service may be permanently terminated without refund.
15.3 Fraud or Mismatched Information:
If any submitted information is found to be false, manipulated, incomplete, unverifiable, or suspicious, HostGraber may:
- Immediately suspend the hosting account;
- Terminate the account permanently after review;
- Blacklist the customer from future services;
- Inform payment processors or legal authorities (if required).
15.4 Verification Triggers:
HostGraber may initiate KYC verification under circumstances including—but not limited to:
- Unusual or high-risk server or payment activity;
- Multiple orders or bulk purchases of services;
- Payment disputes, chargeback attempts, or failed transactions;
- High resource usage or suspicious account access patterns;
- Legal, regulatory, or security concerns requiring identity validation.
15.5 No Refund for Verification Failure:
If the customer refuses or fails KYC verification, or if fraud is detected, the customer will not be eligible for any refund, regardless of service tenure or remaining period.
15.6 Continued Compliance:
HostGraber may require KYC re-verification at any time during the service period. Continued use of services constitutes acceptance of these verification requirements.
16. Strict Suspension Policy
HostGraber reserves the right to suspend any account, with or without prior notice, under the conditions outlined below. Suspension may occur immediately in cases involving security risks, policy violations, or non-payment.
16.1 Grounds for Immediate Suspension:
- Violation of these Terms of Service, Acceptable Use Policy, or any applicable law;
- Hosting prohibited, illegal, abusive, or harmful content;
- Participation in hacking, malware distribution, phishing, or spam activities;
- Resource abuse causing instability or performance degradation of servers;
- Non-compliance with KYC verification requirements;
- Suspicion of fraudulent activity or misuse of payment instruments;
- Account compromise, security breach, or unauthorized access;
- Suspicious login patterns or abnormal service behavior.
16.2 Suspension Due to Non-Payment:
- 24 hours after due date: Services are suspended.
- 48 hours after suspension: Final reminder issued.
- 72 hours after due date: Services may be terminated permanently and all data deleted.
16.3 Reinstatement of Suspended Services:
Services may be restored only after:
- Payment of all outstanding invoices;
- Completion of KYC (if required);
- Removal of abusive content or harmful scripts;
- Resolution of security or policy violations;
- Payment of applicable reactivation fees.
Reinstatement is at the sole discretion of HostGraber and is not guaranteed.
16.4 No Refund for Suspension:
Suspension due to policy violations, non-payment, fraudulent activity, or KYC failure does not qualify for refunds under any circumstances.
17. Strict Termination Policy
HostGraber may terminate an account immediately or after the suspension period based on the conditions listed below. Termination results in permanent deletion of all hosted data.
17.1 Automatic Termination Conditions:
- Failure to renew services within 72 hours of the due date;
- Severe or repeated violations of TOS or AUP;
- Use of fraudulent, stolen, or unauthorized payment methods;
- Failure to comply with KYC verification requirements;
- Involvement in illegal activities, including phishing, malware, or cyberattacks;
- Initiating a chargeback or payment dispute without attempting resolution with HostGraber.
17.2 Termination Due to Fraud or Security Risks:
Accounts detected engaging in fraudulent activities or posing significant security risks will be terminated immediately without prior notice.
17.3 No Liability for Termination:
HostGraber is not liable for any data loss, business interruption, or damages resulting from account termination.
17.4 No Refund Upon Termination:
Refunds will not be issued for terminated accounts, regardless of remaining tenure.
18. Data Loss & Backup Liability
Data protection and backup responsibilities rest solely with the customer unless a paid backup service is explicitly included in the hosting plan.
18.1 Customer Responsibility for Data:
You must maintain independent backups of all files, emails, databases, and configurations stored on your hosting account, VPS, or server.
18.2 No Guarantee of Backups:
HostGraber does not guarantee:
- That backups will be created;
- That backups will be restorable;
- Integrity, completeness, or recency of backups;
- Availability of any backup older than the defined retention cycle.
18.3 Exclusions from Backup Coverage:
Backups (paid or free) do not include:
- Emails or mailboxes;
- Media files (images, videos, audio);
- Temporary or cache files;
- Databases misconfigured for backup systems;
- Files corrupted by malware, hacking, or customer negligence.
18.4 Data Loss After Suspension or Termination:
Once an account is suspended, data access may be restricted. Once an account is terminated, all data is permanently deleted and cannot be recovered.
18.5 No Liability for Data Loss:
HostGraber shall not be held liable for any data loss arising due to:
- Hardware or software failure;
- Server crashes or operating system issues;
- Security breaches or hacking attempts;
- Customer misconfigurations;
- Force majeure or catastrophic failures.
19. Stricter Billing & Payment Policy
HostGraber enforces a strict payment policy to maintain uninterrupted services and prevent abuse.
19.1 Advance Billing:
All hosting services are billed on a prepaid basis. No service will be provisioned without successful payment verification.
19.2 Payment Verification:
Orders may be held temporarily for manual review or KYC verification if payment appears unusual or high-risk.
19.3 Late Payment Enforcement:
- Due date : Suspension
19.4 Chargebacks Prohibited:
Initiating a chargeback results in:
- Immediate suspension of services;
- Permanent termination of the account;
- Blacklisting of customer profile;
- Additional administrative fees.
19.5 Refund Restrictions:
Refunds are not applicable for:
- KYC failure;
- Fraudulent or suspicious activity;
- Suspension due to TOS violations;
- Termination due to abuse or non-payment;
- License-based products or third-party services.
19.6 Customer Responsibility:
It is the customer's responsibility to track renewal dates, maintain valid payment methods, and ensure timely renewal.
20. Billing Policy
If paying via credit card, debit card, net banking, or UPI the account will be set up immediately once the payment is confirmed. If paying by cheque, please allow 5 days for the cheque to clear. If paying via postal orders or cash your account will be set up on the same day.
The 30-day money-back guarantee is only applicable to first-time signups. Second-time and subsequent sign-ups are not eligible for the same. For instance, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.
Refund is not applicable on Domain registration/transfer/renewal, cPanel, Plesk, Control Panel, LiteSpeed, Softaculous, Cloud, VPS, Dedicated Server, Paid Support, SSL Certificates, Sitelock, SpamExperts, WHMCS, Windows OS, SQL, G Suite, Office 365 and any other paid licenses. The modifications done in the pricing pattern or policy by the software license company will take effect immediately on HostGraber clients.
The money-back guarantee is provided on Shared hosting, Reseller hosting, WordPress hosting and Email hosting. No refund will be made if your Service(s) are suspended or terminated for cause.
Transfer fees would be applicable if you wish to transfer the free domain name to some other provider. Without transfer fees the domain will not be released.
The payments made through bank transfer, cheque, money order, cash deposit, or DD are non-refundable. A refund will be added as credit to the hosting account. The refund request placed after 30 days will not be processed and you will not be eligible for any refund.
The cancellation request should be sent through the client area. After sending the cancellation request, it would take 14 days to complete the refund process.
21. Cancellation Process
At any point of time, if you wish to discontinue our services, you can place the cancellation request through your client area. Before that, you need to clear all pending dues (if any).
You can either choose immediate cancellation or request cancellation to happen once your subscription period expires.
If you select immediate cancellation, you will no longer have access to your hosting plan/service. If cancellation after the tenure period is over is selected, you will continue to have access to use the Services until the end of your prepaid term.
It is your responsibility to backup all your data before you place the cancellation request. Once you place the cancellation request, all your data from our server will be deleted and it cannot be retrieved nor restored.
22. Taxes
The price mentioned on the site is exclusive of taxes. To view price with taxes please refer to the Cost Calculator of each plan. The amount inclusive of taxes will be added to your final invoice once you add items to your cart. The taxable amount is non-refundable.
23. Late Payment or Non-Payment
Unpaid invoices may result in the suspension or termination of your web hosting account. Your suspended account will only be restored after clearing the outstanding invoice after which you will be able to access your data.
If your account gets terminated, the data residing on it won't be restored and will be treated as a new account.
If you fail to renew your subscription on time, you will be charged on your invoice. We will not activate new orders or new packages for customers who have an outstanding balance on their account.

25. Account Termination
Your hosting account at HostGraber can get terminated due to the following reasons:
You decide to discontinue.
If during your subscription you no longer want to continue with our services and place a cancellation request with immediate termination, your hosting account will be suspended right away and terminated within 48 hours.
Cancellation upon expiration.
If you place a cancellation request to discontinue our services after your subscription expires, your hosting account will be suspended at the end of the subscription and terminated within 48 hours after expiration.
You did not renew.
If you fail to renew your hosting account on the due date, your hosting account will be suspended after 24 hrs and terminated within 48 hours after expiration.
Violation of Terms of Service.
If you violate our terms of service during your subscription period, it will result in immediate account suspension and termination.
Potential Fraud.
Our anti-fraud system may detect high-risk orders. If verification information is not provided upon request, the account may be suspended and terminated immediately.
Dispute or Chargeback.
If you initiate a dispute or chargeback, we may suspend the account and allow a 7-day period for resolution. If unresolved, termination will occur.
Note: You are advised to maintain a back-up copy of your hosting account to avoid losing your data because of the termination. All your files will be deleted from the server after termination and HostGraber shall not be liable for the same.
26. Indemnification
Customer agrees that they will protect, indemnify, save and hold HostGraber harmless from any stipulations, liabilities, losses, expenses and claims, including reasonable attorney's fees, arising from:
- Any service provided or performed or agreed to be performed;
- Any product sold or distributed in association with HostGraber's Services;
- Any injury to person or property caused by products sold or distributed;
- Loss of electronic files furnished by the customer;
- Copyright violation or defective products.
27. Limitation of Liability
To the maximum extent permitted by applicable law, and without affecting your rights as a Consumer, you agree that HostGraber shall not be liable for any direct or indirect damages including, but not limited to:
- Loss of profits, revenue, business, data or use;
- Service delays, malfunctions, or interruptions beyond our control;
- Data loss due to hardware/software failures;
- Actions performed under technical support guidance;
- Use or inability to use the services.
In no event shall HostGraber’s total liability exceed the fees paid by you for services during the twelve (12) months preceding the claim.
Your rights as a consumer remain unaffected where applicable law does not allow limitation of certain liabilities.
28. Acceptable Usage Policy (AUP)
This AUP governs the use of HostGraber's hosting service. Violation of this AUP may result in suspension or termination of your service. In the event of a dispute between you and HostGraber regarding the interpretation of this AUP, HostGraber's interpretation, in its reasonable commercial judgment, shall govern.
The following is the entire Acceptable User Policy ("AUP") agreement between HostGraber and the personal or corporate account holder. HostGraber provides managed web hosting and domain name services. HostGraber has certain legal and ethical responsibilities consistent with the use of its servers and equipment involved in these services.
HostGraber reserves the right to suspend or cancel a customer's access to any or all services provided by HostGraber when we decide that the account has been inappropriately used.
29. Appropriate Usage
HostGraber web hosting solutions are designed for small and independently operated businesses. Since your website is hosted along with many others on shared infrastructure, usage cannot negatively impact server performance.
Our hosting service is for website hosting only — not as a storage facility for files, backups, archives, images, or media. Hosting accounts used primarily for storage will be suspended or terminated.
We monitor servers 24/7/365 and may take preventive steps if any customer's usage impacts overall stability.
30. Offensive Content
You may not publish or transmit content via HostGraber's service that HostGraber reasonably believes:
- constitutes child pornography;
- constitutes pornography;
- is excessively violent, incites violence or harasses others;
- is deceptive, fraudulent, defamatory or violates privacy;
- exposes proprietary information improperly;
- assists in defeating digital copyright protection;
- infringes trademarks, copyrights, or patents;
- promotes illegal activities, drugs, gambling, or trafficking;
- is malicious, harmful, or may cause retaliation against HostGraber.
HostGraber does not accept websites involving proxy services, warez, escrow, HYIP, MLM, gaming servers, illegal gambling, or lottery programs.
We may terminate service for these activities at our sole discretion with or without refund.
31. Security
You must take reasonable security precautions. You are required to secure your passwords, update software, and maintain responsible security practices.
You may not attempt to gain unauthorized access to systems, accounts, or networks. You may not interfere with service through DoS/DDoS attacks, overloading, or malicious activities.
HostGraber may scan, log, and monitor systems to protect against unauthorized activity.
If your account is compromised, we may disable or terminate it. Cleanup services may incur additional fees.
32. Bulk Commercial Email
Bulk commercial email, mailing lists, and email reflectors are allowed on HostGraber's servers only within limits and legal compliance.
You must ensure:
- Recipients have opted in to receive mail;
- Compliance with CAN-SPAM and other laws;
- Source of email is not obscured;
- No use of third-party mail services that violate these policies.
Any abusive emailing activities may lead to immediate termination.
33. Unsolicited Email
You may not send unsolicited email, either individually or in bulk, to any person who has indicated they do not wish to receive communications.
You must comply with the rules of external networks and mailing list platforms.
34. Material Protected By Copyright
You may not publish, distribute, or copy any material protected by copyright unless you are authorized or permitted by law to do so.
HostGraber will terminate accounts of repeat copyright infringers.
35. Internet Abuse
Unauthorized access, scanning, probing, monitoring, or tampering with systems or networks is strictly prohibited.
You may not:
- Probe or scan networks without permission;
- Monitor data traffic without authorization;
- Launch mail bombing, flooding, or broadcast attacks;
- Forge headers or impersonate systems;
- Engage in activities likely to cause retaliation against HostGraber’s network.
36. Newsgroups, Chat Forums & Other Networks
You must follow the rules and conventions of any external networks you access. Many prohibit off-topic posts, commercial messages, bulk postings, or spam.
37. Disclaimer
HostGraber is under no duty to monitor customer activities and disclaims responsibility for misuse of its network.

- Trademark or copyright violations
- Phishing, malware, scam and abuse reports
